These Terms & Conditions (“Terms”) govern your use of the Kamal Event Décor website and, where noted, set out the general commercial rules that apply to inquiries, quotations, and bookings with us. By accessing this site or engaging us, you agree to these Terms. If you are booking services, your signed Service Agreement/Invoice controls if there is any conflict._

1) Definitions

“Company,” “we,” “us,” and “our” mean Kamal Event Décor. “Client,” “you,” and “your” mean the person or entity making the inquiry or booking. “Event” means the occasion for which our décor services and rentals are provided. “Order” means the written quote, proposal, or invoice we issue.

2) Use of this Website

  • You may browse the site and make legitimate inquiries; you may not scrape, copy, or use automated means to extract content or pricing.

     

  • All text, photos, logos, and designs on this site are our intellectual property or used with permission. You receive a limited, revocable license to view the site; no rights are transferred.

     

  • You may not post unlawful, defamatory, or infringing content in reviews or submissions. We may remove any content at our discretion.

     

  • Third-party links are provided for convenience only; we are not responsible for their content or practices.

     

3) Quotations & Pricing

  • Written quotations are invitations to treat, not binding offers, and are valid only for the period stated (or 7 days if none is stated).

     

  • Prices are in USD and exclusive of taxes, venue fees, tolls, parking, union labor, porterage, or after-hours access charges unless expressly itemized.

     

  • We may correct typographical or clerical errors in a quote, even after acceptance.

     

4) Booking, Deposit & Payments

  • A non-refundable deposit (typically 20%) is required to reserve a date. The specific amount due at booking is shown on your invoice.

     

  • The remaining balance is due no later than 7–14 calendar days prior to the Event, as stated on your invoice. We may suspend performance until payment is received.

     

  • Accepted payment methods appear on your invoice (typically Zelle or Venmo). You authorize us to recover bank/processor fees, chargeback fees, and reasonable collection costs if payments are reversed or late.

     

  • Title to all rental items remains with us at all times.

     

5) Changes, Rescheduling & Cancellations

  • All changes must be requested in writing (email is sufficient) and are subject to our confirmation and any price adjustments.

     

  • If you cancel the Event for any reason, the deposit is non-refundable. Where feasible, and if the venue calendar allows, we may apply the deposit as a credit toward a new date within 12 months of the original Event date.

     

  • If you reschedule, new pricing, availability, and logistics may apply. Promotional pricing may not transfer.

     

6) Force Majeure

Neither party is liable for failure or delay caused by events beyond reasonable control (e.g., extreme weather, acts of God, government restrictions, labor disputes, utility failures, public health emergencies). Deposits remain non-refundable but may be credited to a future date within 12 months subject to availability.

7) Client Responsibilities (Venue & Safety)

You agree to:

  • Provide timely venue access for load-in, setup, and load-out; and to ensure a clear, clean, and safe setup area.

     

  • Confirm any permits, building access rules, union requirements, elevator reservations, loading dock permissions, fire-safety rules, candle policies, and power availability with your venue.

     

  • Supply any tables, chairs, or linens not expressly included in your Order.

     

  • Ensure an adequate inclement-weather backup for outdoor events.

     

  • Supervise children and guests around décor elements, candles, electrical equipment, and structures.

     

If the agreed site conditions are not met, we may adapt the design to fit the conditions, charge reasonable waiting/overtime, or decline unsafe work without liability, with no refund for time lost.

8) Design, Substitutions & Color Variance

  • Event décor involves materials subject to seasonality and supply. We may make reasonable substitutions of florals, fabrics, or hardware of comparable value and aesthetic if a listed item is unavailable.

     

  • Actual colors may vary due to lighting, camera settings, and device screens; color matches are not guaranteed.

     

  • Photographs on the site show prior work and do not guarantee exact replication at a new venue or scale.

     

9) Rentals, Loss & Damage

  • All items are provided as rentals unless expressly sold. Client assumes responsibility from delivery/installation until pickup/teardown.

     

  • You are liable for loss, theft, or damage beyond ordinary wear, including but not limited to stains, wax, burns, tears, water damage, bent frames, broken glass, or missing components. Replacement or repair charges will apply at market value plus reasonable handling.

     

  • Backdrops and structures are fixed once installed; moving them after installation is not permitted without our team.

     

10) Delivery Windows, Overtime & Wait Time

  • We provide an estimated arrival window and require continuous access. Delays caused by venue, vendors, or guests may incur hourly wait/overtime charges at the rate stated on your invoice, with a one-hour minimum.

     

11) Photography & Publicity

You grant us a non-exclusive, royalty-free license to photograph and film our décor at your Event and to use such images (which may incidentally include guests) for our portfolio, website, and social media, unless you object in writing before the Event. We will not publish minors’ faces if you request in advance.

12) Third-Party Vendors

We are not responsible for the acts or omissions of venues, planners, caterers, DJs, photographers, or other third parties. Coordination beyond standard load-in/out is available as an added service.

13) Warranties & Disclaimers

Services are provided with reasonable skill and care consistent with industry practice. Except as expressly stated in writing, we disclaim all other warranties, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). We do not warrant uninterrupted access to this website.

14) Limitation of Liability

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the website, a quote, or an Event will not exceed the amount you actually paid to us for the specific Order giving rise to the claim. We are not liable for any indirect, incidental, special, punitive, or consequential damages, loss of use, lost profits, or loss of goodwill.

15) Indemnification

You agree to indemnify, defend, and hold harmless Kamal Event Décor, its owners, and staff from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of (a) your breach of these Terms or your Order, (b) property damage or personal injury caused by guests or vendors, or (c) your misuse of this website or our rentals.

16) Privacy

Our handling of personal data (including inquiry forms and WhatsApp communications) is described in our Privacy Policy, which is incorporated by reference.

17) Accessibility & Allergies

We strive for accessible setups where feasible; please advise of ADA needs in advance. If using fresh florals, you are responsible for alerting us to allergies among guests; we can suggest alternatives where practical.

18) Governing Law & Dispute Resolution

These Terms and any non-contractual obligations arise under the laws of the State of New Jersey, without regard to conflict-of-laws rules. Venue for any court action will be in the state or federal courts located in Essex County, NJ. Before filing suit (other than to preserve a limitations period or seek injunctive relief), the parties will confer in good faith and consider mediation.

19) Changes to Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the site or services after changes means you accept the revised Terms.

20) Miscellaneous

  • Severability: If any provision is unlawful or unenforceable, the remaining provisions remain in effect.

     

  • No waiver: A failure to enforce a provision is not a waiver.

     

  • Assignment: You may not assign your Order without our written consent. We may assign to a successor in interest.

     

  • Entire understanding (website): These Terms govern website use and general commercial practices and do not replace your signed Service Agreement/Invoice, which controls your specific booking.
